      Ben I-140 dilekcesi verdikten sonra sureciniz konsolosluk mulakatina kadar hizli ilerler demisim.

      Bu dilekçeyi verdikten sonra belki yıllarca beklemek gerekiyor şu anda. Nasıl hızlı ilerliyor anlamadım. Hız anlayışımızda bir farklılık var sanırım.

      Sizin söylediklerinizdeki en bariz sıkıntı I-140'ın teslimiyle ilgili söylediğinizdi. Normalde I-140, LC onaylanır onaylanmaz veriliyor. Sizin söylediğinize göre PD'in Current olmasının beklenmesi gerekiyordu ki en yanlış bilgi bu. Bu form için beklenirse LC'niz expire olur @tufank 'nın dediği gibi.

      PERM dediğiniz EB-3C için toplamda ortalama 1.5 yıl süren uzun ve çok aşamalı bir süreç. Evet, PERM dilekçesi diye bir dilekçe yok. ETA-9089 dediğiniz Labor Certification, onun bir adı ve özelliği var sonuçta, PERM dilekçesi denmiyor. Ve PERM sürecinin başında verilmiyor. Oraya gelene kadar birçok aşaması var.       Konsolosluk süreciyle ilgili verdiğiniz bilgiler tamamen yanlış maalesef,

      1- Perm dilekcesi verilis tarihiniz sizin PD tarihinizdir.
      PERM dilekçesi diye bir dilekçe yok. PERM çok aşamalı bir süreç; Labor Market Test ve Prevailing Wage Detection ile başlıyor. Sizin bahsettiğiniz ETA-9089.

      2- Isin en zor kismi Perm onayi oldugu soylenir. Perm onayi alinca buyuk bir “ohhh” diyebilirsiniz. Bu asamadan sonra sureciniz, konsolosluk mulakatina kadar hizli ilerler. Simdi I-140 dilekcesi verme zamanidir. Bu dilekceyi vereceginiz zaman ister AOS yapin ister Konsoloslukla yurutun, Dates of Filing tarihi onemlidir. Eger PD’niz bu tarihten onceyse basvuru yapabilirsiniz.

      Buradaki bilgilerin tamamı yanlış maalesef. Consular Processing'de en zor kısım yıllarca Priority Date'in Current olmasını beklemek, en azından EB3 için. Ve tabii ki konsolosluk mülakatı.       Böyle bir şey yok. Consular Processing'de sağlık muayenesi + konsolosluk onayı olmadan hiçbir göçmenlik hakkınız yoktur.

      4- I-140 onayindan sonra eger Konsoloslukla devam edecekseniz, dosyaniz Uscis’den NVC’ye transfer olur. Bu sirada size NVC’den Welcome Letter maili gelir. Bu maili aldiktan sonra NVC’ye istenilen belgeleri yuklersiniz ve DS 260 Formu doldurursunuz. Burada “current” olup olmamaya bakilmiyor. DV’de de bakilmiyor. Kazanan herkes bu formu dolduruyor.

      DV'de kurayı kazanıp CN'ınız belli olduktan sonra zaten DS-260'ı doldurabilirsiniz. Normalde DS-260'ın hızlı doldurulması diye bir şeyin bir önemi yoktu. Tamamen CN yani sıranız önemliydi. Ancak burada önce doldurup submit edenlere öncelik verilmeye başlandığı söyleniyor son 1-2 yıldır. Bunun doğruluğunu bilmiyorum. EB-3C'de ise Current olmanız yaklaşık 2-3 yıl sürüyor ve DS-260'ın doldurulma önceliği diye bir kriter yok, sadece Priority Date'iniz önemli mülakat ve kotadaki vize sıranız için.

      Bu AOS ile ilgili ama sanırım bu verdiğiniz bilgi de yanlış. I-485 ve I-765 formlarını "Dates for Filing" tablosuna göre doldurup daha erkenden verebiliyorsunuz. Bu sayede work permit alabiliyorsunuz ve işlemleriniz hızlanmış oluyor. O tablonun var oluş amacı zaten bu.

      Burada bahsedilen FORM-9089'un file edilmesinden kasıt, DOL tarafından onaylı FORM-9089'un USCIS'e sunulması, yani aslında I-140 başvurusunun yapılması diye düşünüyorum. İkisi aynı şey ve USCIS'e I-140 formuyla başvuru yapılabilmesi için zaten FORM-9089'un yani Labor Certification'ın DOL tarafından onaylanmış olması gerekiyor. Bu işlemler de peşpeşe yapılıyor. Dolayısıyla BDV'nin verdiği bilgi de yanlış değil, yine daha detaylı bilgi için sorabilirsiniz tabi. LC gerektiren başvurularda LC başvurusu, gerekmeyenlerde I-140 başvurusu Priority Date olabilir belki.

      Evet, zaten Priority Date denilen şey I-140 formunun file edilmesi yani başvurusunun yapılması :) Dates For Filing, I-485 ve I-765 formlarının doldurulması, yani sadece AOS ile ilgili. ABD içerisinde olup sürecini AOS ile yürütenler bazen çalışma iznini, bazen de Green Card'ını (istisnai olarak bakanlık yoğunluğa göre o ay izin verdiyse) daha erken tarihte alabilsinler diye olan bir süreç. Konsolosluk süreciyle bir ilgisi yok. Türkiye'den başvuranların süreci tamamen farklı ve yukarıda yazdığım gibi, boşuna kafa karışıklığı olmasın.

      Benim demek istediğim Consular Processing. Dediğiniz akıştaki gibi olmuyor. Bu başlıktakilerin çoğu ister BDV Solutions olsun ister eb3vize, genelde konsolosluk süreciyle başvurduğu için zaten karışık olan bir süreç daha da karışık hale gelmesin diye bildiğim kadarıyla süreçleri yazayım;

      PERM süreci tamamlanıp Labor Certification (Çalışma Sertifikası - Form ETA-9089) onaylandıktan sonra işvereniniz I-140'ı doldurup gönderiyor direkt ve onun onay süreci sizin Priority Date'inizin Current olmasından yani Visa Bulletin'den ayrı ve paralel olarak yürüyor.

      Burada I-140 (Immigrant Petition for Alien Worker) onaylandıktan veya bir ihtimal reddedilip onaylandıktan sonra siz muhtemelen Priority Date'inizin Current olmasını beklemeye devam ediyorsunuz. Çünkü I-140'ın bir problem çıkmazsa onaylanması 2-6 ay, Premium Processing ile ortalama 15 gün.

      Konsolosluk sürecinde (Consular Process) takip için Visa Bulletin'de kullanılan tablo sadece Final Action Dates.       Selamlar. Konsolosluk görüşmesi kısmı yanlış olmuş sanırım. "Dates for Filing" sadece Adjustment Of Status (ABD içerisinden statü değişikliği) ile başvuranları ilgilendiriyor olması lazım. Bizim durumumuzda, yani Türkiye üzerinden konsolosluk görüşmesi yapacak kişiler için takip edilmesi gereken tablo sadece "Final Action Dates".

      Çok güzel paylaşım olmuş hocam, eline sağlık. Ağustos ayında 4 aylık bir ilerleme sağlanıp Ocak 2020'den Mayıs 2020'ye kadar gelmişti. Eylül bültenine baktığımda yerinde saymış görünüyor. Hızlanırmı yavaşlarmı şu durumda kestirmek zor ama ortalama olarak default her ay 1 aylık iş yaparlarsa bizim daha 3.5 senemiz var gibi duruyor minimum. Belki 2020-2022 arasında COVID dönemi oluşundan dolayı bekleyen evraklar biraz daha azsa umarım hızlı ilerler, ya da kendileri bir şekilde hızlanırlar :)

      Konuyla ilgili Amerikalı bir avukat yazmış hocam. Bu bir IT hatası ancak görmezden geliniyor demiş. Sanırım avukatların bazı istatistiklere (Avrupaya, Afrikadan daha fazla çeşitlilik vizesi verilmesi gibi) ulaşmasını engellemek için yapmış olabilirlermiş bu avukatın teorisine göre. 2023 case lerine de ulaşılamıyor anladığım kadarıyla, sizin 2020 ye özel bir durum değil.

      Bu şekilde beklerseniz şöyle bir durum var, bilginiz olması açısından yazayım. Zaten şu an girenler vize bülteninin mevcut durumuna bakıldığında minimum 3 yıl bekleyecek. Sürece dahil olmak için eğer bizim sonuçları beklerseniz vize alabilmeniz muhtemelen 7-10 yılı bulacaktır. Ona göre hesap yapmanızı öneririm.

      Kesinlikle öyle hocam. Bu arada başka bir soruma cevap olarak, konsolosluk memurlarının yönetmeliklere ve göçmenlik kanunlarına uygun olarak hareket etmek zorunda olduğunu, sadece niyet okuyarak veya ön yargıyla karar verme yetkileri olmadığını da söylemişti. Onu geçen gün sorduğum için atamadım maalesef ama tam olarak böyleydi. Yani bir önyargı sonucu red yeseniz bile avukatınız itiraz ettiğinde büyük ihtimalle olumlu sonuç alabiliyorsunuz.

      Bangladeş'li bu arkadaş, ABD'de F1 vizesiyle 2 tane master programı tamamlayıp ülkesine dönmüş. EB3'e başvurduğunda I-140 aşamasında reddetmişler. BDV ücretsiz olarak tekrar doldurmuş ve dosyalamış I-140'ı. Sizin hatanız olmayan bir durumda sizden ekstra bir ücret almayacaklarını, tekrar tekrar deneyeceklerini taahhüt ediyorlar. (Eb3vize sözleşmesinde de I-140'ı zaten işveren karşılıyor) Bu case'te de 2. başvuruda onaylanmış dilekçe. Adam iki master mezunu olmasına rağmen konsolosluk mülakatını da ilk denemede geçip sorunsuz almış. O yüzden mesleğin, diplomanın ya da tecrübenin çok sorun olmayacağı ortada.

Yani vasıfsız işçi pozisyonu için fazla vasıflı görünmeniz. Burada geçmişinizdeki iş tecrübelerine rağmen neden bu işi tercih ettiğinize dair bir açıklama yapıp, en az kontrattaki süre kadar çalışacağınıza da ikna ederseniz (sözleşmeyi de göstererek) sorun çıkmama ihtimali daha fazla gibi görünüyor.

      ABD'nin batı kıyısı, Seattle'dan başlayıp San Diego'ya kadar gerçekten muazzam. Deneyimlenebilecek çok fazla tecrübe var. Eşimle en çok batı yakasını gezip dolaşmak istiyoruz. Belki bir karavanla ya da araba-otel şeklinde olabilir. Hata batı yakasını 3 gün boyunca boydan boya geçen yataklı tren bile çok güzel bir deneyim.

      Onun haricinde Alaska ve Hawai çok sofistike yerler. Fırsat bulunabilir mi bilmiyorum ama bulduğum bir dönem ikisini de kesinlikle görmek isterdim. Doğu yakası da New York ve Miami başta olmak üzere gezilir tabii ki detaylı ama daha az ilgimi çekiyor açıkçası.
